The Law Council of Australia has developed these guidelines to give assistance to lawyers representing clients in the mediation of civil and commercial disputes.
Mediation is a cost-effective process that encourages the outcome of a win-win resolution for both parties within a short space of time. Mediation costs are typically low as the process usually only lasts one or two days, and the resources required are limited to that of the parties involved.
The Institute had a number of members who were also interested in providing a mediation service and the Institute changed its name to the Australian Institute of Family Law Arbitrators and Mediators as a result and in conjunction with Bond University developed training modules for lawyers who wished to be family law mediators.

This was in spite of the fact that often parties decline mediation because lawyers perceive that very complex cases are unsuitable for it. The research conducted for the report revealed that mediation may offer considerable benefits and that lawyers should con-sider mediation more favourably, even in “difficult” cases, the Law Society said.
